Article 1 - GENERAL PROVISIONS
These general terms and conditions apply to all products marketed by Valrupt TGV Industries on its website www.traditiondesvosges.com.
Consequently, any product supplied by Valrupt TGV Industries implies the customer's unreserved acceptance of these general terms and conditions of sale, to the exclusion of any catalogue, prospectus or other advertising document which are for indicative purposes only.
The general terms and conditions specify, in particular, the conditions for ordering, payment, delivery and management of customer returns.
The contractual information is governed by French law and is presented in French and will be confirmed by the customer during the online purchase procedure.
Valrupt TGV Industries reserves the right to cancel any order from a customer with whom a payment dispute exists, without the customer being able to claim any compensation whatsoever.
Valrupt TGV Industries reserves the right to modify these general terms and conditions of sale at any time.

Article 3 - GENERAL DESCRIPTION OF PRODUCTS
Valrupt TGV Industries provides customers with the essential characteristics of the ordered goods, namely the general description of the product including specific features, dimensions, material and finish indications.
Valrupt TGV Industries reserves the right to modify or change the products presented in the catalog without prior notice.
The choice and purchase of a product are the sole responsibility of the customer.
The qualitative characteristics are displayed next to each item when it is presented on the website. The photographs and characteristics illustrating the products offered on the website are for indicative purposes only. Under no circumstances can Valrupt TGV Industries be held liable in the event of any errors. Non-contractual photos.
Article 4 - PRICE
The selling prices of products listed on www.traditiondesvosges.com are in Euros, all taxes included and excluding delivery costs.
Valrupt TGV Industries reserves the right to modify its prices indicated on its website at any time and without prior notice.
Ordered products will be invoiced based on the rates in effect at the time of order registration, subject to availability on that date, typing errors and printing errors.
The customer will always be informed before the final registration of their order of the delivery costs related to their order (invoiced in addition to the selling price), and payment will be requested from the customer for the total amount of the purchase.
Valrupt TGV Industries may modify the price after having previously notified the customer, who will retain the option to accept the new offer or may cancel the order.
Delivery rates are independent of Valrupt TGV Industries.
Article 5 - ORDER
When the customer clicks on the "order" icon, the order is irrevocably processed. Its acceptance cannot subsequently be challenged, except in application of the "right of withdrawal" article.
The sale will only be considered valid and final after the customer receives an email confirming the order and after full payment has been collected.
As part of its order control and acceptance procedure, Valrupt TGV Industries reserves the right to ask the customer for additional supporting documents. The order will only be validated upon receipt of these documents.
The delivery time of the order may be affected by any delay in the transmission of information. In the event of failure to provide the documents, Valrupt TGV Industries reserves the right to cancel the order.
Article 6 - AVAILABILITY
Product offers visible on the site are considered "in stock" and are valid while supplies last on www.traditiondesvosges.com.
These are theoretical stocks maintained by a real-time database, with each sold product automatically removed from stock.
In the event of an irrecoverable stock shortage on www.traditiondesvosges.com, the customer will be contacted by email as soon as possible. An alternative will be offered:
1) find a substitute product at an equivalent price
2) outright cancellation of the missing product from the order
Article 7 - PAYMENT
Regardless of the payment method chosen, your order will only be processed once validated.
All orders are payable in Euros. To pay for their order, the customer has all the payment methods listed on the order form: Credit card (Carte Bleue, Mastercard, Visa, American Express), Paypal, Applepay, Googlepay, Scalapay and bank transfer.
The card is debited on the day of the order, subject to special conditions authorized by Valrupt TGV Industries.
The proposed price must be paid according to the payment procedure described during the registration process. The customer guarantees to Valrupt TGV Industries that they have the necessary authorizations to use the payment method they have chosen when registering the order form.
Valrupt TGV Industries reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and level of execution, in the event of non-payment of all or part of the sum due by the customer, or in the event of a payment incident.
The user is responsible for payment by credit card for the ordered product. Valrupt TGV Industries cannot be held responsible for payment problems related to the operation of the e-commerce service.
The website www.traditiondesvosges.com is secured by an SSL encryption system.
Bank Rejection
Any order dispute must be made by contacting Valrupt TGV Industries: www.traditiondesvosges.com, "contact" section, at 03.29.23.60.51.
Any credit card chargeback initiated by the customer will irrevocably result in their blacklisting from the site's mail-order customer list, and from its commercial partners. No further orders can subsequently be placed by the implicated customer.
Request for supporting documents
For certain large orders and if payment is made by credit card, the customer may be asked to provide certain supporting documents, in order to prevent fraud, which is unfortunately commonplace in our modern society.
The e-merchant is entitled to request supporting documents provided that the customer is clearly informed of this before the order is validated.
Naturally, the collection of information complies with the rules set out by the law on data processing and liberties (principles of fairness, proportionality, purpose, etc.).
Given the nature of the information collected, data retention must be strictly limited in time.
Article 8 - DELIVERY
Products are delivered to the delivery address indicated by the customer on the order form, within the geographical limits offered by www.traditiondesvosges.com.
The customer can, upon request, obtain a billing address different from the delivery address by validating the option provided for this purpose on the order form.
To enable the delivery of products ordered on www.traditiondesvosges.com to the customer, Valrupt TGV Industries has chosen to work with LA POSTE So Colissimo and DPD.
The customer will be able to track the progress of their parcel using a tracking number that will be provided to them during their order and will be available in the member area of www.traditiondesvosges.com.
For orders including at least one item personalized with embroidery, an additional delay of up to 5 days is added.
Responsibility of Tradition des Vosges for delivery and transport risks
The e-merchant's liability is fully engaged regarding delivery.
The main obligation of Tradition des Vosges will be to deliver the goods within the period stipulated in the contract.
This responsibility cannot under any circumstances be transferred to the carrier responsible for delivery.
If the latter loses the package, Tradition des Vosges must reimburse the consumer and seek recourse against its carrier.
Delivery problems
Delivery is made by handing over the product to the customer at the location indicated when ordering (Delivery address). The handing over of the product by the carrier results in the customer signing a delivery note. The customer must indicate on this note, in the form of handwritten reservations, accompanied by their signature, any anomaly concerning the delivery (damaged package). This verification is considered to have been carried out once the customer, or a person authorized by them, has signed the delivery note.
If, at the time of delivery, the original packaging is damaged, torn, or opened, the customer must then check the condition of the items. If they have been damaged, the customer must absolutely refuse the package and note a reservation on the delivery slip (package refused because opened or damaged) and inform Valrupt TGV Industries within three days.
In case of non-delivery, the customer must contact the Tradition des Vosges customer service within 30 days of the date the package was taken in charge by the carrier (generation of a tracking number communicated to the customer).
Failure to comply with the procedure described above, no claim from the customer will be accepted.
Errors or anomalies in delivery
In the event of an anomaly or error concerning the delivery (such as damage, broken products, damaged products) and/or in the event of non-conformity of the products in nature or quality with the indications on the delivery note, the customer must inform Valrupt TGV Industries under the following conditions: On the same day (on the delivery note in the form of "handwritten reservations", accompanied by the customer's signature, the note must be given to the carrier at the time of delivery) or at the latest on the first working day following delivery by contacting Valrupt TGV Industries at www.traditiondesvosges.com, section "Contact", by phone 03.29.23.60.51.
By this means, a return authorization, accompanied by a number assigned by Valrupt TGV Industries, will be communicated by email to the customer. Any claim that is not made according to the rules defined above and within the deadlines will not be taken into account and will release Valrupt TGV Industries from all responsibility towards the customer. Valrupt TGV Industries covers the cost of returning the product in case of dispute (defect, delivery error) by sending a "return slip". In case of delivery error or exchange, any product to be exchanged must be returned to the carrier as a whole, in its original condition and in its original packaging. The product will automatically either be exchanged subject to availability or reimbursed if it is not available.
Product Returns
In the event of a product return, the refund will be made in the name of the customer who placed the order. The return request must be made to customer service (infos@traditiondesvosges.com) or via the contact form. If the request is accepted, a return label (Colissimo) will be provided to the customer. Free return only applies to metropolitan France. Upon receipt of the return label, the customer must drop off their package at the post office within 10 working days. Embroidered items cannot be returned or exchanged.
Article 9 - DELIVERY TIMES
Delivery times depend on the items ordered and the chosen delivery method. Valrupt TGV Industries undertakes to deliver the goods sold within thirty (30) days from the order. In all cases, Valrupt TGV Industries is released from its delivery obligations, particularly in cases of force majeure, such as fire, flood, strikes, or reasons beyond its control.
Failing delivery by the expiry of this period, the customer will have the option to cancel their order. The sums paid by the customer will then be refunded without delay, to the exclusion of any other compensation. In the event of abnormal delivery delay, the customer must report it by email or phone to Valrupt TGV Industries, who may then conduct an investigation with the carriers.
To speed up package tracking, customers are asked to specify their order number. An investigation with the carrier can last up to twenty-one (21) working days. If the product is found during this period, it will be immediately re-routed to the customer's home or the recipient designated in the order form. However, if the ordered product is not found after this twenty-one (21) day investigation period, Valrupt TGV Industries will proceed, at its expense, with a new shipment of the products ordered by the customer. In the event that the ordered product is no longer available, the provisions referred to in Article 6 will apply.
Please note that the re-shipment of packages returned to Valrupt TGV Industries due, in particular, to an error on the part of the customer when placing the order regarding the delivery address, their negligence in collecting the package from postal services, etc., remains entirely and fully their responsibility and not that of Valrupt TGV Industries.
Article 10 - WARRANTY CONDITIONS
General
Products purchased from Valrupt TGV Industries via its website www.traditiondesvosges.com are covered by the Tradition des Vosges® warranty. To benefit from the product warranty, it is essential to keep the product purchase invoice and attach the original when returning the product (we recommend that customers make a copy of the invoice). Warranties do not cover abnormal or improper use of the products (washing, ironing, care).
No commercial (paid) warranty is offered by Tradition des Vosges.
Defects of conformity that appear within twelve months of delivery of the goods are presumed to have existed at the time of delivery, unless proven otherwise.
Colorfast Guarantee
All plain qualities are guaranteed "GRAND TEINT" (colorfast). By "GRAND TEINT", Tradition des Vosges® guarantees the dye against bleeding and washing at 60°.
SANFOR Guarantee
Through the SANFOR treatment, the fabric is stabilized, it has already reacted. The risks of adaptation to different mattress thicknesses are considerably reduced, the fibers retain great flexibility, combined with a silky feel. The item is therefore shrink-proof.
Returns
Any product to be returned under warranty must be returned only with the agreement of Valrupt TGV Industries under the conditions mentioned in Article 8.
Article 11 - RETENTION OF TITLE CLAUSE
The products sold as defined in the order form remain the property of Valrupt TGV Industries until full payment of the price by the customer. During the period of retention of title, the customer shall bear the risk of loss or destruction of the sold item upon delivery. In the event of recovery or liquidation proceedings against the customer, the ownership of the delivered products that remain unpaid may be claimed by Valrupt TGV Industries. In the event of resale of products supplied by Valrupt TGV Industries while the customer has not paid the full price, the customer undertakes to inform any buyer of this retention of title clause affecting said products and of Valrupt TGV Industries' right to claim from them either the products concerned or their price.
Article 12 - RIGHT OF WITHDRAWAL
The customer has a period of thirty (30) clear days, starting from the receipt of the last good or batch or the last item, for an "order for several goods delivered separately or in the case of an order for a good composed of multiple lots or items whose delivery is staggered over a defined period", to inform Valrupt TGV Industries of their decision to cancel their order and receive a refund, without penalties, except for return costs.
The consumer returns or restitutes the new goods, in their original packaging, "without undue delay and, at the latest, within 30 days following the communication of their decision to withdraw"
The refund is made using the same payment method as that used during the initial order (unless otherwise agreed with the consumer), without undue delay and at the latest within 14 days from the date on which the company is informed of the decision to withdraw, in accordance with Article L.221-24 of the Consumer Code.
Valrupt TGV Industries reserves the right to defer the refund of the order until full receipt of the products corresponding to the written request made by the customer (only the product is refunded, not the delivery costs). In applying this right of withdrawal, all risks relating to the return of a product are the sole responsibility of the customer.

Article 13 - REFUND
In the event of withdrawal, Valrupt TGV Industries shall refund all sums paid, including standard delivery costs, without undue delay and at the latest within 14 days from the date on which it is informed of the consumer's decision to withdraw (Article L.221-24 of the Consumer Code), in accordance with the following terms:

reimbursement made using the same payment method as that used for the order (unless otherwise agreed by the consumer);
-
in case of late reimbursement beyond the legal deadline, the amount due shall be increased in accordance with Article L.241-4 of the Consumer Code (increasing surcharge depending on the number of days of delay).
Any other type of reimbursement (excluding legal withdrawal or extended commercial period of 30 days) will only be made in the cases provided for by these general terms and conditions of sale.
Article 14 - FORCE MAJEURE
Valrupt TGV Industries shall not be liable for any non-performance or delay in the performance of any of its obligations if such non-performance or delay results from an event beyond its control and which it could not reasonably foresee. This includes any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.

Article 16 - APPLICABLE LAW
These general terms and conditions of sale are governed, both for their interpretation and for their execution, by French law. In the event of a dispute, the customer will first contact Valrupt TGV Industries to obtain an amicable solution. In the absence of a solution between the parties, the French courts will have sole jurisdiction.
Article 17 - PERSONAL DATA
The information collected by Valrupt TGV Industries during any order is necessary for its management. In accordance with Regulation (EU) 2016/679 (GDPR) and the amended "Informatique et Libertés" law of January 6, 1978, the customer has a right of access, rectification, erasure, limitation, opposition and portability of their data, as well as the right to lodge a complaint with the CNIL (www.cnil.fr).

Article 18 - PROOF
The computerized records, kept in the computer systems of each party, under reasonable security conditions, will be admitted as proof of communications, contracts and payments between the parties. Pursuant to Article L 134-2 of the Consumer Code, any electronic contract with an amount greater than or equal to 120 euros will be kept by Valrupt TGV Industries for a period of 10 years.
Article 19 INTELLECTUAL PROPERTY
The design and graphics of the traditiondesvosges.com website are considered an original work under intellectual property law. All texts, comments, product illustrations and images reproduced on the traditiondesvosges.com website are reserved under copyright and intellectual property rights worldwide. In accordance with the provisions of Article L 122-5 of the intellectual property code, only the private use of the site may be made by users. Any total or partial reproduction of the traditiondesvosges.com site without its authorization is strictly prohibited and constitutes an act of counterfeiting.
Article 20 - NEWSLETTER
Tradition des Vosges offers internet users who wish to do so to subscribe to a free service called "Newsletter".
This newsletter, which may contain advertising messages, primarily has an educational and informative purpose.
It contains information allowing internet users to better use traditiondesvosges.com.
In accordance with:
- The law for "trust in the digital economy" (articles L. 33-4-1 of the post and electronic communications code and L. 121-20-5 of the consumer code)
- The "informatique et libertés" law amended on August 6, 2004 and the recommendations of the CNIL
internet users who no longer wish to receive the Newsletter can unsubscribe using the unsubscribe link found on each of them.
In addition, recipients of the newsletter have a right of opposition that can be exercised:

A confirmation email is then sent.

Article 21 - Mediation
1- In the event of a dispute, the Client must first contact Valrupt TGV Industries customer service.

2- If the Client considers that they have not received a satisfactory response from customer service to their complaint (or no
response) beyond 2 months, they may contact C&C-médiation, an entity designated as the referring mediator.
In the event of an unresolved dispute, the consumer mediator can be contacted at the following addresses:

Please note: The client must demonstrate that they have already contacted customer service in writing for their complaint – previously and in writing – of the
professional.
The mediator will then handle the dispute (less than 12 months old) if the client's request is declared admissible.
3- If necessary, the parties will retain the right to refer the matter to the competent court.
